El estudio se desarrolló en la microcuenca del río Mijitayo, municipio de Pasto, Colombia, la cual es una de las principales abastecedoras de agua para la ciudad de Pasto. El objetivo fue analizar el marco legal e institucional del manejo del recurso hídrico en la microcuenca para luego proponer estrategias de gestión integral. Si bien existen dos leyes, tres decretos y diez instituciones relacionadas con el agua, el cumplimiento de la normativa legal es precario en la microcuenca además, la normativa no corresponde a la realidad socioambiental existente. Las instituciones presentes no trabajan de manera coordinada y la interacción de las instituciones con las comunidades es pobre, lo que limita la participación activa de la población en la toma de decisiones y la gestión de sus recursos naturales. Los proyectos emprendidos no reciben ningún seguimiento y la falta de empoderamiento local incide en el pobre desempeño de las propuestas desarrolladas. Es necesario promover un proceso de gestión conjunta, con liderazgo y participación real de todos los actores claves en el manejo del agua para mejorar el manejo del recurso en la zona de estudio. The study was carried out in the Mijitayo River microwatershed, Pasto, Colombia, which is one of the main suppliers of water for the city of Pasto. The objective was to analyze the legal and institutional framework for the management of water resources and to propose strategies for integrated management. Though there are two laws, three decrees and 10 institutions working with water supply in the Mijitayo microwatershed, compliance with legal regulation is precarious in addition, those regulations are outdated and do not fit the present socioenvironmental situation. Institutions and organizations do not work in a coordinated manner and the interaction of institutions with the communities is poor. As a result the people’s participation in decision making and management of natural resources is limited. The projects undertaken are not monitored and the lack of local empowerment strongly affects project performance.
